General terms and conditions of sale

CLAUSE N°1

These general conditions of sale apply to any purchase made by the customer on the website Sbd.fr owned by SAS BTZ Sport registered with the CCI in France under number 920 231 628 and whose headquarters is located at 39 rue du docteur Jacques Touati, 95340 in Persan.

Clause n°2

SBD France reserves the right to modify the general sales conditions at any time without prior notice.

Clause n°3

Before placing an order, the customer acknowledges having read, understood and accepted the General Conditions of Sale.

Clause n°4

Any order placed on the site implies unconditional acceptance by the customer of these Terms and Conditions of Sale.

Clause n°5

At the time of purchase, the customer must be at least 18 years old or, if he/she is a minor, be able to justify the agreement of his/her legal representatives. SBD France reserves the right to ask the customer to confirm, by any appropriate means, his identity, his eligibility and the information communicated during the purchase.

Clause n°6

SBD France is committed to being transparent about the composition of its products and the mandatory information that the customer must receive under applicable law. Unless otherwise stated, all products sold are new and comply with current European legislation and standards applicable in France.

Clause n°7

The Customer is expressly informed that SBD France is not the producer of the products, in the sense of the law n°98-389 of May 19, 1998 and relating to the responsibility for defective products. Therefore, in case of damage caused to a person or property due to a defect in the product, only the responsibility of the producer of it can be engaged by the customer, based on the information on the product packaging.

Clause n°8

In accordance with article 4 of the decree n°78-464 of March 24, 1978, the provisions of the present document cannot deprive the customer of the legal guarantee which obliges SBD France to guarantee him against all the consequences of the hidden defects of the sold product.

Clause n°9

According to article L.217-4 and L.217-5 of the French Consumer Code, SBD France is required to deliver a product that conforms, i.e. that is fit for the purpose expected of a similar product and that corresponds to the description given on the website. This conformity also implies that the product has the qualities that a buyer can legitimately expect following the public statements made by SBD France, including in advertisements and on labels.

Clause n°10

The products ordered remain the property of SBD France until full payment for their sale is received.

Prices and Fees

The prices are indicated in Euros and are valid for all territories. They take into account possible reductions as well as the French VAT applicable on the day of the order.

The prices indicated on the site are guaranteed on the day of the order within the limits of available stocks, and except for obvious typographical errors or omissions. SBD France reserves the right to modify its prices at any time. The prices indicated do not take into account the shipping costs which are calculated and invoiced or offered at the time of the validation of the order and according to the country of delivery.

 

Shipping and delivery terms

SBD France delivers in France and in all overseas territories.

Delivery is free for purchases of €100 or more (in mainland France only) to a relay point.

SBD France dispatches orders within 2 working days from Monday to Friday, excluding public holidays, festive periods and new collections where lead times can be longer, up to 4 working days.

Delivery will be made by :

- Colissimo en Point Retrait: Your parcel will be delivered in 2 to 3 working days from Monday to Friday, except on public holidays.
- DHL Express: Your parcel will be delivered the next day at home as soon as the order has been dispatched, from Monday to Friday, except on public holidays.

Overseas territories should expect delivery within 5 to 10 working days via Colissimo. Overseas territories may be subject to customs duties. By ordering from SBD France, the customer acknowledges and accepts that these taxes will be paid by the customer.

The delivery of orders can sometimes go beyond the communicated deadlines due to unforeseen events linked to political, social or sanitary conditions or to logistic problems.

SBD France apologizes in advance for these delays and for the delays caused by the delivery services.

Any anomaly concerning delivery (open parcel, damaged parcel, etc.) must be reported to SBD France's customer service department, with proof of photos, on the day of delivery and receipt of the parcel, so that a claim can be made to the carriers. Please note that it is also quite possible that these anomalies are the responsibility of the customs authorities. In such cases, a customs notification will be visible on the parcel. In all cases, SBD France declines all responsibility.

The delivery information you provide to SBD France when placing an order must be complete, accurate and up-to-date. A tracking number will be e-mailed to the customer as soon as the order has been processed. Delivery tracking can be checked online on the carrier's website. If an error is made in the delivery information, SBD France cannot be held responsible for undelivered packages, delays or return to sender. You are invited to contact the carrier to correct the shipping address and ensure delivery. If the package is returned to SBD France, the order may be reshipped after the address has been corrected (shipping costs at your expense) or reimbursed (shipping costs not included).

Delay and No Delivery

You will find your tracking number in the shipping confirmation email. You can check the transit status via the carrier's website.

If there is a delay or you are absent during the delivery, we invite you to approach the carrier.

If, on the other hand, a parcel is lost by the carrier and not found at the end of the investigation period, SBD France will return a parcel to the customer at its own expense. If the product(s) are no longer available, SBD France will offer the customer a refund (including shipping costs).

The information that the customer provides to SBD France when placing an order must be complete, accurate and up-to-date. If this is not the case, SBD France cannot be held responsible for undelivered, delayed or returned parcels. The customer will be invited to contact the carrier in order to correct the shipping address and ensure delivery. If the package is returned to SBD France, the order may be reshipped after the address has been corrected (shipping costs to be borne by the customer) or refunded (shipping costs not included).

 

Return and exchange policy

Before any validation of order, the customer is invited to check its contents: quantity, references of products (models, colors and sizes), delivery address and means of payment. SBD France cannot be held responsible in case of error. 

For any return or exchange, the customer will have to fill the form of return and exchange available on the site as well as to contact the customer service: [email protected] in the 14 days which follow the reception of the parcel. After this period, no return, exchange or refund will be possible.

The customer service is open from Monday to Friday from 8am to 5pm.

The customer can be refunded under certain conditions: 

SBD France guarantees reshipment and refund of items only if all items are returned in the same original condition. The items must be undamaged, stained, washed, deformed, worn, without traces of make-up and with all labels still intact. Equipment may not be used for training purposes.

Socks cannot be returned or exchanged.

Items must be returned in their original packaging to the following address:

After reception and verification of the articles, SBD France will proceed to the exchange or refund of the order. The expenses of forwarding and return remain with the load of the customer. In the cases where the articles would not respect these criteria, SBD France reserves the right not to proceed to the refunding for the simple reason that these articles could not be put back on sale.

All exchanges and refunds will be made within 7 working days once SBD France has acknowledged receipt of the customer's return package. Refunds will always be made on the same payment method as the one used for the order.

All SBD Apparel products undergo a rigorous quality control process. We expect our products to meet the highest standards and guarantee our products against manufacturing defects. In the event of non-conformity and defective item, SBD France will refund or exchange the item. SBD France apologizes in advance for this inconvenience and will bear the shipping costs. The customer should contact the after-sales service: [email protected] with the reference of the order and the picture of the defect.

If you have received the wrong item, SBD France apologizes in advance for this error and invites you to contact the after-sales service: [email protected] with your order number and the photo of the item received by mistake. A return or an exchange will be possible. SBD France will pay all shipping costs.

If a return is made on an order paid with a gift card, the amount of the item will be credited back to the gift card in question. No discount or gift card will be subject to a bank refund.

 

Method of payment

To pay his order, the customer has at his disposal several methods of payment proposed (CB with Stripe and Paypal). The methods are secure and fast.

The customer guarantees SBD France that he/she has all the necessary authorizations to use the chosen payment method. SBD France guarantees the security and confidentiality of data transmitted online as part of the online payment on the site. It is specified that all information relating to payment provided on the site are transmitted to the site's bank or Paypal account and are not processed on the site directly.

SBD France reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in full or in part a previous order or with whom a payment dispute is being administered.

 

Rights of withdrawal

The customer has the right to return the product within fourteen (14) days at the latest. The withdrawal period expires fourteen (14) days after the day on which the customer, or a third party other than the carrier, takes physical possession of the product. Beyond this period, the right of withdrawal cannot be applied and returns will be refused. No credit note, exchange or refund will be possible.

 

Applicable rights

The present General Conditions as well as the relations between the customer and SBD France are governed by French law. In case of dispute, only the French courts will have jurisdiction. However, prior to any recourse to an arbitral or state judge, negotiation will be preferred in a spirit of loyalty and good faith with a view to reaching an amicable agreement in the event of any dispute relating to this contract, including those concerning its validity. The party wishing to implement the process of negotiation and amicable settlement must inform the other party by registered letter with acknowledgement of receipt, indicating the elements of the dispute. If at the end of a period of fifteen (15) days, the parties do not reach an agreement, the dispute will be submitted to the competent jurisdiction.

 

Gift Card 

The Gift Card is a dematerialized digital Gift Card sent by email.

You can enter as much or as little as you like, from the minimum €50. 

The person to whom you are giving the Gift Card will receive it by email a few moments after your purchase. You will also receive a copy of the proof of purchase by email. You can pay by credit card or Paypal.

The Gift Card can be used throughout the SBD France site.

If the total of the order is higher than the value of the Gift Card, the difference will have to be paid by the client by card or Paypal.

If the total of the order is less than the value of the Gift Card, the total of the purchase order will be deducted from the Gift Card balance. You will receive another Gift Card by email for the value of the remaining balance. 

The Gift Card has no expiration date. Under no circumstances may it be reloaded, resold or converted into cash, even if partially used.

The customer has a period of 7 days from the date of purchase to withdraw and request a refund.

The card must not have been used otherwise no refund will be possible. After this period, no refund will be possible even if the card has not been used.

SBD France declines any responsibility in case of theft, loss or fraud and will not be able to proceed to any refund. You will have to contact your bank and your insurance company.

In the event that a Gift Card is not working, please contact customer service.

We apply the SBD France Terms and Conditions of Use and Sale. When you purchase, receive or use a Gift Card, you agree to these terms and conditions of use as regulated by French law.
